WHEREAS
That on 13 March 2012, in compliance with article 46, section I, of the Federal Act on Metrology and Standardisation, the Ministry of Labour and Social Welfare submitted to the National Consultative Committee for Standardisation on Occupational Safety and Health the Preliminary Draft Amendment to this Official Mexican Standard, and that the aforementioned Committee considered it correct and agreed that it be published as a Draft in the Official Journal of the Federation; That to comply with articles 69-E and 69-H of the Federal Act on Administrative Procedure, the corresponding Preliminary Draft was submitted for the consideration of the Federal Commission for Regulatory Improvement, which issued a favourable opinion on it; That on 2 April 2012, in compliance with the Agreement establishing the organisation and Operating Rules of the National Consultative Committee for Standardisation on Occupational Safety and Health, and with article 47, section I, of the Federal Act on Metrology and Standardisation, the Draft amendment to Official Mexican Standard NOM-028-STPS- 2004, Work organisation-Safety in chemical substance processes, to become PROY- NOM-028-STPS-2012, Work management system-Safety in processes involving hazardous chemical substances, was published in the Official Journal of the Federation so that, within the 60 calendar days following that publication, interested parties could submit their comments to the Committee; That having received comments from five petitioners, the Committee proceeded to study them and resolved upon them in due course, this department publishing the respective responses in the Official Journal of the Federation of 14 August 2012, in compliance with article 47, section III, of the Federal Act on Metrology and Standardisation; That as a result of incorporating the comments submitted on the Draft amendment to Official Mexican Standard NOM-028-STPS-2004, Work organisation-Safety in chemical substance processes, to become PROY-NOM-028-STPS-2012, Work management system-Safety in processes involving hazardous chemical substances, as well as of the final review of the draft itself, various amendments were made to provide clarity, consistency and legal certainty as regards the provisions applying in workplaces, and That in view of the foregoing considerations, and since the National Consultative Committee for Standardisation on Occupational Safety and Health granted its approval, the following is issued: OFFICIAL MEXICAN STANDARD NOM-028-STPS-2012, WORK MANAGEMENT SYSTEM-SAFETY IN PROCESSES AND CRITICAL EQUIPMENT HANDLING HAZARDOUS CHEMICAL SUBSTANCES

1. Purpose
To establish the elements of a management system for organising safety in processes and critical equipment handling hazardous chemical substances, so as to prevent major accidents and protect people, workplaces and their surroundings from harm.
2. Scope
2.1 This Official Mexican Standard is in force throughout the national territory and applies to workplaces that: a) Carry out specific processes of: 1) Oil extraction; 2) Natural gas extraction; 3) Natural gas storage and distribution; 4) Production of liquefied petroleum gas (LP gas); 5) Storage and distribution of liquefied petroleum gas (LP gas); 6) Production of petrochemicals, or 7) Refining of crude oil and basic petrochemicals, or b) Handle hazardous chemical substances in processes and critical equipment, in volumes equal to or greater than the threshold quantities indicated in Appendix A of this Standard.
2.2 The quantification of hazardous chemical substances shall be carried out in accordance with one or more of the following criteria: a) The installed storage and/or process capacity for the hazardous chemical substance in the workplace, and/or b) The quantity of hazardous chemical substances present as raw materials and/or finished product in store and/or in process.
2.3 The following workplaces are excluded from compliance with this Standard: a) Those handling hazardous chemical substances in processes and critical equipment in quantities lower than those specified in the list in Appendix A of this Standard; b) Those storing flammable liquids in atmospheric tanks kept below their boiling point, without requiring cooling or refrigeration; c) Those using hydrocarbons only as fuels for their internal consumption; d) Those selling petrol or gas to the end user, or e) Those carrying out the retail sale of hazardous chemical substances or products containing them.

This Standard makes no reference to other Official Mexican Standards in force.
4. Definitions
For the purposes of this Standard, the following definitions apply:
4.1 Major accident: The undesired event involving processes and critical equipment with hazardous chemical substances, which gives rise to an uncontrolled release of those substances or of energy, and which may cause injuries, deaths and damage in the workplace, the surrounding population or the environment.
4.2 Management of change: The systematic application of policies, programmes and procedures for identifying, assessing and authorising any modification to processes and critical equipment that may alter, vary or affect their safety.
4.3 Risk management: The application of strategies in organising processes and critical equipment so as to eliminate, reduce or control the risks identified where hazardous chemical substances are handled.
4.4 Risk analysis: The application of one or more specific methods to identify, assess and generate control alternatives for the significant risks associated with processes and critical equipment handling hazardous chemical substances.
4.5 Internal audits: The methodical review that the employer carries out in its workplace to verify compliance with the management system for organising the safety of processes and critical equipment handling hazardous chemical substances.
4.6 Labour authority; employment authority: The competent administrative units of the Ministry of Labour and Social Welfare that carry out inspection functions in occupational safety and health matters, and the corresponding units of the federal states and the Federal District acting in support of them.
4.7 Changes: The temporary or permanent modifications carried out to processes and critical equipment handling hazardous chemical substances that relate to the technology, the organisation, the procedures and the installations of the workplace.
4.8 Threshold quantity: The value, equal to or greater in mass (kg), of the hazardous chemical substance established in Appendix A of this Standard, whatever the physical state in which it is found, whose uncontrolled release, from natural causes or causes arising from human activity, may cause a major accident.
4.9 Root causes: The essential facts that give rise to a major accident in a process and/or critical equipment.
4.10 Contractor: The natural or legal person providing services to the workplace; who is directly or indirectly involved with processes and critical equipment handling hazardous chemical substances, with their own or subcontracted equipment, machinery and/or labour, and who, by reason of their work, may add to or heighten a risk.
4.11 Safety devices: The mechanisms or systems of the machinery, equipment or installations whose purpose is to be triggered by an event that puts the process and/or critical equipment at risk, and which prevent or reduce the consequences or control its operating conditions.
4.12 Critical equipment: The storage tanks and pressurised vessels, together with their emergency shutdown systems; the pressure relief and venting devices and systems; the process protections, such as controls, protective interlocks, sensors and alarms, and the pumping and pipework systems, among others, intended to contain hazardous chemical substances, whether or not they are interconnected in the production process, in which the failure of the safety devices, of the mechanical integrity, or in the handling of the substances or equipment during their operation, may cause a major accident.
4.13 Mechanical integrity: The set of interrelated activities focused on ensuring the reliability of the safety conditions of critical equipment during its operation, so as to prevent failures, potential risks or accidents. It covers the phases from design, manufacture, construction, installation, operation and maintenance through to its dismantling.
4.14 Safe operating limits: The values of the operating variables of critical equipment that are recognised as safe, according to its design characteristics, and which shall not be exceeded during its operation.
4.15 Handling: The use, storage, transformation, manufacture, transfer, conveyance and/or movement of hazardous chemical substances in the workplace.
4.16 Maintenance: The action of reviewing, repairing and testing critical equipment or its installation, with a view to keeping it in operation or carrying out its refurbishment.
4.17 Operations involving hazardous chemical substances: The processes in which physical changes to hazardous chemical substances take place, such as drying, distillation, absorption, adsorption, filtration and heat transfer, among others.
4.18 Pre-start-up: The actions that make it possible to verify that the critical process equipment is in safe operating condition, before it is put into operation, so as to prevent occupational risks.
4.19 Procedure: The sequential description of the activities of a specific task or tasks, applicable to the operation, maintenance, review and investigation, among others, of processes and critical equipment.
4.20 Critical process: The industrial activities and operations involving the use, storage, transformation, manufacture, transfer, conveyance and/or movement of hazardous chemical substances in the workplace, or the combination of these.
4.21 Safety protocol for handover and acceptance: The procedure for accepting, handing over and auditing the installation, maintenance, modification or alteration of a process or critical equipment, from the start to the completion of a job and/or project.
4.22 Boiling point: The temperature at which a liquid stored at atmospheric pressure passes into the gaseous state.
4.23 Review: The internal process of the workplace in which machinery, equipment or an installation is physically examined.
4.24 Risk: The probability that the handling of one or more hazardous chemical substances causes a major accident to occur and, consequently, the consequences of that accident.
4.25 Hazardous chemical substance: Any substance contained in Appendix A of this Standard.
4.26 Hazardous work: The activities that, for maintenance reasons, are carried out in the installations, on critical equipment or in areas adjacent to it, and which may give rise to a major accident.
4.27 Verification unit (VU): The natural or legal person accredited and approved, under the Federal Act on Metrology and Standardisation and its Regulations, to carry out the conformity assessment with this Standard.
5. Employer's duties
5.1 Establish and keep in force an occupational safety and health policy on the management of safety in processes and critical equipment handling hazardous chemical substances in the workplace.
5.2 Have a safety management system for processes and critical equipment handling hazardous chemical substances, in those workplaces subject to the application of this Standard.
5.3 Have and keep up to date in the workplace: a) The risk analysis of the processes and critical equipment handling hazardous chemical substances, with the identification, assessment and preventive and/or corrective recommendations for the significant risks, in accordance with Chapter 7 of this Standard, or b) The environmental risk study referred to in article 147 of the General Act on Ecological Balance and Environmental Protection and, where applicable, the accident prevention programme (APP).
5.4 Have a safety procedure and the authorisations for carrying out hazardous work that could cause major accidents, based on Chapter 8 of this Standard, comprising the authorisation of the personnel who will carry out the activities relating to the operation of hazardous chemical substances, of critical equipment or in the areas adjacent to them.
5.5 Manage the risks of the processes and critical equipment, in accordance with Chapter 9 of this Standard.
5.6 Manage the mechanical integrity of the critical equipment of the workplace, taking into account its maintenance, review and testing and, where applicable, that of its safety devices, in accordance with Chapter 10 of this Standard.
5.7 Manage the changes to processes and critical equipment, including the information relating to temporary or permanent changes to the hazardous chemical substances, the technologies, the equipment and the corresponding safety procedures, in accordance with Chapter 11 of this Standard.
5.8 Have an emergency response plan based on Chapter 12 of this Standard.
5.9 Have an internal audit programme for reviewing the processes and critical equipment handling hazardous chemical substances, in accordance with Chapter 13 of this Standard.
5.10 Have a procedure for investigating major accidents, in accordance with Chapter 14 of this Standard.
5.11 Maintain the information system on processes and critical equipment, in accordance with Chapter 15 of this Standard.
5.12 Have a procedure for the work carried out by contractors, based on Chapter 16 of this Standard.
5.13 Have an annual programme for training the workers involved in the operation and maintenance activities of the processes and critical equipment handling hazardous chemical substances; the performance of hazardous work; emergency response; the conduct of internal audits, and the investigation of major accidents, in accordance with Chapter 17 of this Standard.
5.14 Communicate and make known to the personnel involved in the processes and critical equipment: a) The risks to which they are exposed, according to their activity in operations involving hazardous chemical substances; b) The measures for preventing and controlling risks; c) The elements of the management of change; d) The safety programmes and procedures, as well as the risks relating to their activities; e) The results of the risk analysis; f) The documents arising from mechanical integrity; g) The results of the investigation of major accidents and of the audits, and h) The periodic progress of the programme for complying with the control measures arising from the risk analysis in the process.
5.15 Have procedures for pre-start-up, start-up, normal operation, maintenance, emergency shutdowns and alterations of the critical equipment.
5.16 Have a list of the personnel responsible for authorising changes to the processes and critical equipment.
5.17 Provide the safety and hygiene committee with the procedure for investigating major accidents.
5.18 Communicate and make known to the contractors the risks relating to the processes and/or critical equipment where they will carry out their activities.
5.19 Present to the labour authority the documents that this Standard requires the employer to draw up and hold, when it so requires.
6. Workers' duties
6.1 Take part in the training relating to operations involving hazardous chemical substances and the maintenance relating to processes and critical equipment provided to them by the employer.
6.2 Observe the procedures relating to the processes and critical equipment that the employer makes known.
6.3 Hold the corresponding authorisation to carry out hazardous work.
6.4 Inform the employer of any risk condition they detect, in accordance with the respective procedures.
6.5 Take part in the interviews conducted with them, based on this Standard.
7. Risk analysis
7.1 The risk analysis of the processes and critical equipment handling hazardous chemical substances shall take into account, at least: a) The objectives, scope and timescales for carrying out the process risk analysis; b) The gathering of the following information: 1) The description of the process and/or critical equipment; 2) The operating conditions of the process and/or critical equipment; 3) The diagrams and plans of the process and/or critical equipment; 4) The piping and instrumentation and control diagrams (installation plans); 5) The electrical diagram plans and lists of alarms and switches; 6) The safety data sheets of the hazardous chemical substances; 7) The system for identifying and communicating hazards and risks for hazardous chemical substances; 8) The instructions or operating procedures for hazardous chemical substances; 9) The reports on accidents that have occurred in the workplace or in similar processes; 10) The previous risk analyses, where applicable, and 11) The plant layout with the location of the processes and critical equipment handling hazardous chemical substances; c) The identification and assessment of the risks associated with the process and/or critical equipment, taking into account at least the following: 1) The physical and chemical properties of the hazardous chemical substances; 2) The operating history of the process, such as the frequency of chemical releases, the age of the process and any other relevant factor; 3) The possible consequences arising from major accidents with the hazardous chemical substances used, and 4) The number of people who may be affected within the workplace installations or in their vicinity; d) The recognition and appraisal of the probable damage to the processes and critical equipment handling hazardous chemical substances from geological, hydrometeorological, chemical-technological, health-ecological and socio-organisational phenomena; e) The techniques selected for the risk analysis of the process and/or critical equipment, including the following information: 1) The identification of the potential risks; 2) The analysis of the causes; 3) The analysis of consequences; 4) The recommendations for reducing or eliminating a risk; 5) The identification of the points of interest for further studies; 6) The identification of the frequency of occurrence, and 7) The determination of the protection required, and f) The preventive and/or corrective recommendations for managing the risks identified.
7.2 The risk analysis of the processes and critical equipment handling hazardous chemical substances shall be updated: a) Every five years; b) Before modifications to the processes and critical equipment are carried out; c) When a new process is planned, and d) As a result of the investigation of a major accident.
8. Safety procedures and authorisations for hazardous work
8.1 The safety procedures for hazardous work shall: a) Prevent major accidents; b) Be drawn up in writing, be up to date, include their period of validity and have a traceability or identification code, and c) Relate mainly to the following activities or operations: 1) The isolation of electrical power lines and of pipework with hazardous substances, pressurised pipework and pipework with thermal fluids; 2) Entry into confined spaces; 3) Locking and tagging in installations, machinery and equipment to control any type of energy; 4) Welding and cutting work, open flame or work that generates sparks; 5) Hazardous reactions, such as exothermic, explosive, flammable and pressure-generating reactions; 6) The handling of flammable, reactive and toxic substances; 7) The monitoring of explosive or toxic atmospheres, and 8) The maintenance of atmospheric and pressure vessels that have contained hazardous materials (corrosive, reactive, explosive, toxic and flammable).
8.2 The authorisation to carry out hazardous work shall include the following information: a) The name and signature of the person responsible for the area; b) The name and signature of the person who is going to carry out the hazardous work; c) The document reference number; d) The time and date scheduled for the start and completion of the activity; e) The description of the activity; f) The place where the activity will be carried out; g) The list of safety and health measures for carrying out the work, taking into account the recommendations and precautions adopted for: 1) Earthing, inerting, single-pass electrical power supplies, detectors, ventilation, washing, among others, and 2) Fire prevention; h) The personal protective equipment for carrying out the task; i) The period of validity of the authorisation, allowing for a maximum of one working shift of the person or persons carrying out the activity, and j) The name and signature of the person who authorises and verifies that the points mentioned in this paragraph are complied with.
9. Risk management
9.1 Risk management shall contain the following elements: a) A list of the risks identified, assessed and ranked by means of the risk analysis study; b) The risk acceptance criteria, based on the probability of occurrence and the consequences they cause. 9.2 The risk management system shall: a) Have a person responsible for risk management; b) Define the risk management approach, with criteria for eliminating or reducing risks; c) List the risks and propose control alternatives; d) Generate the recommendations for control measures to address risks; e) Establish the technical and economic feasibility of the recommendations for control measures; f) Present the conclusions of the cost-benefit assessment of the control measures; g) Choose the control measures according to their feasibility for addressing risks, taking into account the following actions: 1) The review and selection of the control measures according to their feasibility; 2) The search for new recommendations for control measures if the previous ones are not feasible, in accordance with the elements of risk management, and 3) The reappraisal of the technical and economic feasibility of the new recommendations for control measures; h) Have the resources for implementing the control measures to be carried out; i) Contain the dates for scheduling and putting in place the risk management system; j) Establish the safety assessments necessary before the control measures are implemented; k) Determine the monitoring of compliance with the programme for managing the risk, with the control measures selected, and l) Provide for the reappraisal of the risks after the control measures have been applied.
10. Management of the mechanical integrity of critical equipment
10.1 The management of mechanical integrity shall be applied, among others, to: a) The storage tanks and pressurised vessels; b) The emergency shutdown systems; c) The pressure relief and venting devices and systems; d) The process protections, such as controls, protective interlocks, sensors and alarms; e) The pumping and pipework systems, and f) The specifications of the materials used in modifications or changes to the equipment.
10.2 The management of the mechanical integrity of critical equipment shall have procedures aimed at: a) Verifying the safe functioning of the critical equipment relating to the process; b) Ensuring that the materials and spare parts used in the critical equipment meet the specifications required in the process; c) Witnessing that the periodic reviews and tests of the equipment are carried out; d) Carrying out maintenance based on the manufacturer's recommendations and/or, where applicable, on the risk analysis and the company's procedure; e) Reviewing compliance with the corrective actions arising from maintenance; f) Reviewing new and replacement equipment for compliance with the design requirements of the process where it will be installed, and g) Defining the acceptance criteria or limits; the frequency of reviews and tests, in accordance with the manufacturer's recommendations; good engineering practice; regulatory requirements; industry practice, and the workplace policies, among others.
10.3 The file on the mechanical integrity of critical equipment shall hold the following documentation: a) A current list of the critical equipment, with a diagram of its location in the workplace; b) The safety procedures referred to in paragraph 8.1 of this Standard; c) A maintenance programme covering the critical equipment and, where applicable, its safety devices; d) A programme of reviews and tests of the critical equipment and, where applicable, of its safety devices; e) The record of the type and date of the maintenance carried out on each piece of critical equipment and, where applicable, on its safety devices, and f) The records of the reviews and tests carried out on the critical equipment and, where applicable, on its safety devices.
10.4 The records of the reviews and tests carried out on the critical equipment and, where applicable, on its safety devices, shall contain the following information: a) The dates of the reviews or tests; b) The name of the qualified or certified person(s) carrying out the reviews or tests; c) The identification of the critical equipment; d) The description of the work carried out; e) The acceptance criteria or limits, as well as the results of the reviews or tests; f) The stages required and those followed to correct the deficiencies found outside the acceptable criteria or limits, and g) The calculation of remaining life and retirement limits.
11. Management of change
11.1 Management of change shall be established for processes and critical equipment, so as to keep control of the changes introduced and to support decision-making on their application.
11.2 The aspects that shall be taken into account in the management of change are the following: a) The hazardous chemical substances: 1) The raw materials; 2) Changes to catalysts; 3) The inhibitors used, and 4) The development of new products; b) The process technology: 1) The operating procedures; 2) The formulation during operations involving hazardous chemical substances; 3) The products arising from operations involving hazardous chemical substances, and 4) The operating conditions, taking into account their variables and ranges; c) The equipment and instrumentation, by reason of: 1) The materials of construction; 2) The equipment specifications; 3) The previous pipework arrangements; 4) The experimental equipment, and 5) The adaptations to the process controls and alarms; d) The new equipment; e) The equipment not available on the market; f) The energies used, and g) Experimentation.
11.3 Management of change shall take into account, before making any modification to the procedures, the following aspects: a) The technical basis for the proposed change; b) The purpose of the change; c) The impact of the change on safety and health; d) The modifications made to the operation; e) The modifications to the maintenance activities; f) The authorisation requirements for the proposed change, and g) The updated information.
11.4 Management of change shall have written procedures for: a) The review of the process operations; b) The recording of the changes; c) The risk analysis of the changes to be introduced; d) The training of personnel so that they recognise the changes and alert them to them; e) The identification and assignment of the responsible persons with the authority to make modifications; f) The mechanism for the periodic authorisation of the changes made during excessive workloads, such as maintenance or start-ups, and g) The maximum durations of temporary changes, specifying the requirements to be met and the person responsible for supervising them.
11.5 The management-of-change procedure shall contain, at least, the following: a) The document identified with a reference number or code; b) The result of the risk analysis for the change; c) The updated operating and maintenance procedures; d) The updated plans, diagrams and technical information; e) The updated training requirements, and f) The authorisation and signature of the personnel responsible for the change.
12. Emergency response plan
12.1 The emergency response plan shall contain, as applicable, the following: a) The different emergency scenarios in the workplace; b) The identification and location of the areas, premises or buildings where the processes and critical equipment handling hazardous chemical substances are situated; c) The identification of the evacuation routes, emergency exits and staircases, lower-risk zones and assembly points, among others; d) The types of workplace response teams -communication, evacuation and first aid-, with the responsibilities and functions to be carried out; e) The conduct of emergency drills, according to the risks that may arise, at least every six months; f) The alerting procedure should an emergency occur, in accordance with the detection mechanism in place; g) The criteria for requesting outside assistance in an emergency that could culminate in a major accident, taking into account the recognition of the emergency and the directory of specialised services in the locality; h) The procedure for evacuating workers, contractors, employers and visitors, among others, taking into account persons with disabilities; i) The procedures for operating the emergency equipment, tools and systems; j) The use of personal protective equipment by the members of the response teams; k) The protocol to be followed in the session handing over command control to the external specialised emergency response services; l) The mechanisms for coordinating the members of the emergency response teams with the external specialised emergency response services; m) The procedure for decontaminating the response team members, their clothing and equipment; n) The procedures for identifying damage and assessing the safety conditions of the workplace after the emergency; o) The procedure for the return to normal operating activities; p) The resources for its implementation, and q) The person or persons responsible for carrying it out.
12.2 For the conduct of drills, a programme shall be put together that takes into account at least: a) The names of those in charge of coordinating them and of establishing the safety measures to be adopted while they are carried out; b) The dates and times of their execution; c) Their scope: comprehensive or by workplace area, with or without prior notice, personnel involved, among others; d) The type of emergency scenarios; e) The sequence of the actions to be carried out, and f) The participation of the specialised emergency response services in the locality, where these exist, if the type of emergency scenario planned so provides.
12.3 The results of the emergency drills shall be recorded with at least the following information: a) The name, denomination or business name of the workplace where the drill was carried out, together with its full address; b) The workplace areas where it took place; c) The number of people who took part; d) Its duration; e) The resources used; f) The detection of deviations from the planned actions; g) The recommendations for updating the emergency response plan, and h) The names of those in charge of coordinating it.
13. Internal audit programme
13.1 The internal audit programme for reviewing the processes and critical equipment shall contain, at least, the procedures for verifying: a) The implementation of this Standard; b) The start-up tests at the beginning of operation; after shutdowns, major maintenance, changes or modifications, and following a major accident; c) The functioning specifications of the equipment and auxiliary systems, and d) The closure and abandonment of the site where the plant was located, so as to prevent risks to the population and the environment caused by dismantling, the disposal of materials and hazardous waste.
13.2 The internal audit programme for the processes and critical equipment shall contain the records of the deviations identified and the corrective measures taking into account the compliance programme and the follow-up of those measures.
13.3 Internal audits shall be carried out at least every two years.
14. Procedure for investigating major accidents
14.1 The procedure for investigating major accidents shall contain: a) The approach of the investigation; b) The identification of the root causes; c) The techniques or methodologies to be used in the investigation; d) The terms for delivering the investigation report, and e) The guidelines for a plan to follow up the preventive and corrective actions.
14.2 The report on the investigation of major accidents shall contain the following information: a) The date, time and place where the accident occurred; b) The hazardous chemical substances involved in the accident; c) The people affected by the accident; d) The process and/or critical equipment where the accident occurred; e) The description of the accident; f) The root causes that gave rise to the accident; g) The consequences arising from the accident; h) The preventive and corrective measures applicable to the root causes; i) The name and signature of the people taking part in the investigation, and j) The statistics on the major accidents that have occurred, where applicable, so that they serve as a basis for guiding the corrective and preventive measures.
15. Information system on processes and critical equipment
15.1 The information system on processes and critical equipment shall comprise the following: a) The plans of the structures, systems and components of the installation where the process and/or critical equipment is situated; b) The information and studies associated with the sizing of the structures, systems and components of the installation and of the process and/or critical equipment; c) The control measures for the structures, systems and components identified as process risks; d) The flow diagrams of the critical processes; e) The piping and instrumentation diagrams of the critical equipment; f) The information used as the basis for the process engineering design; g) The acceptable operating limits and/or safe operating limits of the critical equipment; h) The manuals and catalogues of the equipment and components making up the process; i) The process risk analysis; j) The safety procedures for start-up, normal operation, emergency shutdowns, maintenance and repairs of the critical equipment, as well as for hazardous work; k) The operating and maintenance procedures for the critical equipment; l) The emergency response plan; m) The instructions provided for dismantling the installations, and n) The documents of the process safety system.
16. Contractors
16.1 The requirements applicable to contractors shall cover the following: a) The safety criteria for engaging services relating to processes and critical equipment; b) A safety protocol with the criteria for handing over and accepting work carried out which, where applicable, specifies the deviations and corrective actions, and c) The instructions for informing the employer should an incident occur in the workplace where they carry out their activities.
16.2 For work carried out through contractors, a procedure shall be held that takes into account at least: a) The policy specifying the occupational safety and health criteria for engaging them; b) A training and instruction programme with specific plans for the contractor's workers, especially for new starters and, where applicable, their participation in the programme provided by the employer of the workplace; c) A protocol for monitoring that the work carried out meets engineering requirements and standards, and d) The guidelines for checking that the contractor's workers comply with the workplace safety procedures referred to in paragraph 8.1, subparagraph c), of this Standard.
17. Training programme
17.1 The annual training programme shall take into account the personnel involved in: a) The operation and maintenance of the processes and critical equipment; b) The performance of hazardous work; c) Emergency response; d) The conduct of internal audits; e) The investigation of major accidents, and f) The workplace safety rules applied to contractors.
17.2 The training shall take into account: a) The risks to which the personnel are exposed; b) The previous accidents that have occurred in the activity assigned, and c) The general and specific safety rules and good practice of the area where the work is to be carried out.
17.3 The training programme for the operation and maintenance personnel of the processes and critical equipment shall comprise, at least, the following topics: a) The general data of the process and its potential risks; b) The critical equipment and its potential risks; c) The specific information for hazardous work relating to the process; d) The operating or maintenance procedures for the critical equipment of the process, and e) The information relating to the maintenance of the critical equipment of the process.
17.4 The training programme for the personnel who carry out hazardous work shall include matters relating to the safety procedures for performing that work and to the authorisations required.
17.5 The training programme for the personnel responsible for emergency response shall take into account: a) The different emergency scenarios in the workplace; b) The content of the emergency response plan for the various scenarios; c) The emergency drills, based on the risks that may arise; d) The participation of the response team leaders and members in emergency response; e) The procedure for communicating and notifying the emergency; f) The criteria for requesting outside assistance in an emergency that could culminate in a major accident; g) The procedure for evacuating workers, contractors, employers and visitors, among others, taking into account persons with disabilities; h) The procedures for operating the emergency equipment, tools and systems; i) The use of personal protective equipment by the members of the response teams; j) The protocol to be followed in the session handing over command control to the external specialised emergency response services; k) The mechanisms for coordinating the members of the emergency response teams with the external specialised emergency response services; l) The procedure for decontaminating the response team members, their clothing and equipment; m) The procedures for identifying damage and assessing the safety conditions of the workplace after the emergency, and n) The procedure for the return to normal operating activities.
17.6 The training programme for the personnel who carry out the internal audits shall take into account: a) The planning and conduct of the audit; b) The audit records, and c) The preparation of the report.
17.7 The training programme for the personnel who carry out the investigation of major accidents, including those forming part of the safety and hygiene committees, shall relate to the following topics: a) Concepts and definitions; b) Theories of the causes of major accidents; c) Techniques for analysing and investigating major accidents; d) Gathering the information and preparing the report on the investigation of major accidents, and e) Procedure for complying with and following up the measures to control the causes detected.
18. Verification units
18.1 The employer shall have the option of engaging an accredited and approved verification unit, as indicated by the Federal Act on Metrology and Standardisation, to verify compliance with this Standard.
18.2 Verification units assessing conformity with this Standard shall apply the compliance criteria established in the conformity assessment procedure of Chapter 19 of this Standard.
18.3 Accredited and approved verification units assessing compliance with this Standard shall issue a report, which shall contain: a) Workplace data: 1) The name, denomination or business name; 2) The full address (street, number, district, municipality or borough, city, federal state, postcode), and 3) The name and signature of the employer or their representative, and b) Verification unit data: 1) The name, denomination or business name; 2) The registration number granted by the accreditation body; 3) The approval number granted by the Ministry of Labour and Social Welfare; 4) The code and name of the Standard verified; 5) The dates on which the accreditation and the approval were granted; 6) The result of the verification; 7) The name and signature of the person responsible for issuing the report; 8) The place and date of signature of the report; 9) The period of validity of the report, and 10) The registration number of the report granted by the Ministry of Labour and Social Welfare when the respective return is filed.
18.4 The reports issued by verification units shall be valid for two years, unless the conditions on which they were issued change.
18.5 The interested party who obtained the conformity assessment of this Standard through a verification unit shall keep the verification report, which shall be available to the labour authority when it so requests.
19. Conformity assessment procedure
19.1 This conformity assessment procedure applies both to inspection visits carried out by the labour authority and to verification visits carried out by verification units.
19.2 The aspects to be verified during the conformity assessment of this Standard shall be examined, as applicable, by documentary review, records or interviews, as follows: Type of

19.4 To conduct the interviews with the workers on their understanding of the sections of this Standard, Table III.1 and Table III.2 of Reference Guide III, Selection of the personnel to be interviewed and sample questionnaire of this Standard, may be applied.
19.5 Compliance with this Standard may be evidenced by: a) The minutes and records corresponding to the comprehensive assessments of the Occupational Safety and Health Self-Management Programme by the federal labour inspectorate, where they evidence at least 90 per cent compliance with this Standard, or b) The report of a verification unit accredited and approved under the Federal Act on Metrology and Standardisation.
19.6 The documentary evidence and the administrative records referred to in this Standard may be presented in printed form or on magnetic media, and shall be kept for at least five years.
20. Enforcement
Enforcement of compliance with this Standard is the responsibility of the Ministry of Labour and Social Welfare.

This Official Mexican Standard does not concord with any international standard, as no reference existed at the time of its drafting.
TRANSITIONAL PROVISIONS
FIRST. This Official Mexican Standard shall enter into force eighteen months after its publication in the Official Journal of the Federation. SECOND. During the period indicated in the preceding article, employers shall comply with Official Mexican Standard NOM-028-STPS-2004, Work organisation-Safety in chemical substance processes, and with the Conformity Assessment Procedure of Official Mexican Standard NOM-028-STPS- 2004, Work organisation-Safety in chemical substance processes, or shall make the adaptations needed to observe the provisions of this Official Mexican Standard NOM-028-STPS-2012, Work management system-Safety in processes and critical equipment handling hazardous chemical substances. In the latter case, the labour authorities shall provide, at the request of interested employers, advice and guidance for implementing compliance, without the employers becoming liable to penalties for non-compliance with the standard in force. THIRD. From the date on which this Standard enters into force, Official Mexican Standard NOM-028-STPS-2004, Work organisation-Safety in chemical substance processes, published in the Official Journal of the Federation of 14 January 2005, and the Conformity Assessment Procedure of Official Mexican Standard NOM-028-STPS-2004, Work organisation-Safety in chemical substance processes, published in the Official Journal of the Federation of 31 December 2008, shall cease to have effect. Threshold quantities of hazardous chemical substances A.1 To determine the threshold quantity of each of the hazardous chemical substances present or available in the workplace, the following shall be taken into account: 1) The raw material storage vessels and pipework; 2) The train of interconnected equipment, taking into account all the equipment and its pipework; 3) The transfer pipework and the finished-product storage vessel, and 4) The temporary stores. Pre-start-up safety reviews and operating procedures The content of this guide is a supplement for a better understanding of this Standard and is not mandatory. I.1 Pre-start-up safety reviews Consider the development and implementation of a pre-start-up system before the critical process equipment is put into operation, including the safety information setting the basis for its start-up. I.1.1 The pre-start-up system will make it possible to monitor compliance with the following conditions: a) That the construction and installation comply with the design specifications and the manufacturers' recommendations; b) That the operating and maintenance procedures and the emergency response plans are up to date; c) That a risk analysis has been carried out and that the resulting recommendations have been applied, and d) That the management-of-change procedure is carried out. I.2 Operating procedures It is recommended that written operating procedures be developed and implemented containing clear, specific instructions for safely carrying out the activities involved in each critical process. I.2.1 The written procedures may include steps for each phase of the operation covering: a) The initial start-up; b) Normal operations; c) Temporary operations; d) Emergency shutdowns, including the conditions under which they are required and the clear assignment of responsibilities to each of the operators that ensure they will be carried out promptly and safely; e) Emergency operations; f) Normal shutdowns, and g) Start-up after a normal shutdown or an emergency shutdown. I.2.2 The written procedures may specify the safe operating limits, including: a) The consequences of deviating from them, and b) The steps required to correct or avoid the deviations. I.2.3 The written procedures may include safety and health considerations on: a) The properties of the risks present from the chemicals used in the processes; b) The precautions required to prevent worker exposure, including engineering controls, administrative controls and personal protective equipment; c) The control measures to be applied should exposure or physical contact, or contact of any other kind, occur; d) Quality control for raw materials and control of the inventory level of hazardous chemical substances, and e) Any other type of particular or special risk. I.2.4 The procedures may be subject to the following requirements: a) Be fully accessible to the workers who operate or maintain a process; b) Be reviewed as often as necessary to ensure that they match the reality of current operation and that they include the changes made to chemical processes, technology, equipment and installations; c) Be reviewed at least every year to ensure that they are up to date and accurate in their instructions, and d) Develop and implement safe working practices, including those relating to tagging/locking out; entry into confined spaces; opening of pipework and process equipment; control of access to installations for maintenance; contractors' work, laboratory work or other support personnel. These safe working practices may be applied by workers of the company or of the contractors.
