WHEREAS
That on 26 June 2012, in compliance with article 46, section I, of the Federal Act on Metrology and Standardisation, the Ministry of Labour and Social Welfare submitted to the National Consultative Committee for Standardisation on Occupational Safety and Health the Preliminary Draft Amendment to this Official Mexican Standard, and that that Committee considered it correct and agreed that it be published as a Draft in the Official Journal of the Federation; That to comply with articles 69-E and 69-H of the Federal Act on Administrative Procedure, the corresponding Preliminary Draft was submitted for the consideration of the Federal Commission for Regulatory Improvement, which issued a favourable opinion on it; That on 5 July 2012, in compliance with the Agreement establishing the organisation and Operating Rules of the National Consultative Committee for Standardisation on Occupational Safety and Health, and with article 47, section I, of the Federal Act on Metrology and Standardisation, the Draft amendment to Official Mexican Standard NOM-012-STPS-1999, Safety and hygiene conditions in workplaces where sources of ionising radiation are produced, used, handled, stored or transported, to become PROY-NOM-012-STPS-2012, Safety and health conditions in workplaces where sources of ionising radiation are handled, was published in the Official Journal of the Federation so that, within the 60 calendar days following that publication, interested parties could submit their comments to the Committee; That having received comments from three petitioners, the Committee proceeded to study them and resolved upon them in due course, this department publishing the respective responses in the Official Journal of the Federation of 12 October 2012, in compliance with article 47, section III, of the Federal Act on Metrology and Standardisation; That as a result of incorporating the comments submitted on the Draft amendment to Official Mexican Standard NOM-012-STPS-1999, Safety and hygiene conditions in workplaces where sources of ionising radiation are produced, used, handled, stored or transported, to become PROY-NOM-012-STPS-2012, Safety and health conditions in workplaces where sources of ionising radiation are handled, as well as of the final review of the draft itself, various amendments were made to provide clarity, consistency and legal certainty as regards the provisions applying in workplaces, and That in view of the foregoing considerations, and since the National Consultative Committee for Standardisation on Occupational Safety and Health granted its approval, the following is issued: OFFICIAL MEXICAN STANDARD NOM-012-STPS-2012, SAFETY AND HEALTH CONDITIONS IN WORKPLACES WHERE SOURCES OF IONISING RADIATION ARE HANDLED

Transitional provisions
1. Purpose
To establish the safety and health conditions for preventing risks to workers exposed to sources of ionising radiation, to the workplace and to its surroundings.
2. Scope
This Official Mexican Standard is in force throughout the national territory and applies to all workplaces where sources of ionising radiation are handled.
3. References
For the correct interpretation of this Standard, the following Official Mexican Standards in force, or those superseding them, shall be consulted:
3.1 NOM-005-NUCL-1994, Annual limits on intake (ALI) and derived air concentrations (DAC) of radionuclides for occupationally exposed personnel.
3.2 NOM-008-NUCL-2011, Control of radioactive contamination.

4. Definitions
For the purposes of this Standard, the following definitions are established:
4.1 Labour authority; employment authority: The competent administrative units of the Ministry of Labour and Social Welfare that carry out inspection functions in occupational safety and health matters, and the corresponding units of the federal states and the Federal District acting in support of them.
4.2 Radioactive contamination: The undesirable presence of radioactive substances on surfaces or contained in solids, liquids or gases, including the human body, according to the limits determined by the competent regulatory body.
4.3 Control: The process by which the relevant preventive or corrective actions arising from the evaluation of the contaminating agents in the working environment are implemented, so that the permissible exposure limits are not exceeded.
4.4 Decontamination: The process by which radioactive contamination is reduced to levels equal to or lower than the values indicated in NOM-008-NUCL-2011.
4.5 Radioactive waste: Any material that contains or is contaminated with radionuclides, or with concentrations or levels of radioactivity, higher than those laid down by the National Commission for Nuclear Safety and Safeguards in the corresponding Official Mexican Standard, and for which no use is foreseen.
4.6 Dosimetry: The measurement of the dose of ionising radiation.
4.7 Stochastic effects: Those cases in which the probability of the effect occurring is considered a function of the dose, with no threshold dose, and which may become manifest both in the exposed individual and in their descendants.
4.8 Dose equivalent: The quantity that correlates the absorbed dose (Sievert, Sv) with the probability of stochastic effects appearing. The dose equivalent is calculated using the equation: H= D x Q x N Where: H = Dose equivalent; D = Absorbed dose in J/kg; Q = Quality factor, and N = Product of all other modifying factors (N= 1).
4.9 Effective dose equivalent: The weighted sum of the dose equivalents for the different tissues of the human body. The effective dose equivalent is calculated using the equation: HE = W T HT Where: HE = Effective dose equivalent; WT = Tissue weighting factors, and HT = Dose equivalent for each tissue.
4.10 Radiological emergency: The act, omission, situation or occurrence originating from an abnormal, unexpected irradiation event, the control or elimination of which requires immediate corrective action.
4.11 Radiological safety officer: The person authorised by the National Commission for Nuclear Safety and Safeguards to oversee and apply everything relating to radiological safety and protection in the workplace, in accordance with the General Radiological Safety Regulations.
4.12 Evaluation: The process by which the contaminating agents of the working environment are measured and the results compared against the permissible exposure limits. It comprises the selection of the sampling method; the determination of the measurement locations and points; the type and number of samples or readings to be taken; the times and frequency of the measurements; the characteristics of the measuring equipment, as well as the requirements for its calibration.
4.13 Source of ionising radiation: Any equipment or material capable of generating ionising radiation in quantifiable form.
4.14 Handling: Any activity involving the use, storage, production or transport of sources of ionising radiation.
4.15 Radiological safety manual: The document whose purpose is to ensure that all actions involving the handling of sources of ionising radiation are carried out on the basis of the standards and under appropriate radiological protection procedures, so as to reduce the exposure of occupationally exposed personnel to the greatest possible extent.
4.16 Competent regulatory body: The Ministry of Energy, through the National Commission for Nuclear Safety and Safeguards; the Ministry of Health, through the Federal Commission for Protection against Health Risks, and the Ministry of Communications and Transport, responsible for regulating the use, storage, production or transport of sources of ionising radiation.
4.17 Occupationally exposed personnel; OEP: Those workers who, in the exercise of and by reason of their occupation, are permanently exposed to ionising radiation. Workers who may occasionally be exposed to this type of radiation in the course of their work are excluded, provided that the annual effective dose equivalent they receive does not exceed the limit laid down in the General Radiological Safety Regulations for members of the public.
4.18 Ionising radiation: All electromagnetic or corpuscular radiation capable of producing ions, directly or indirectly, through its interaction with matter.
4.19 Radionuclide: The unstable nucleus of an atom, unstable because its proportion of neutrons is greater or smaller than the number of protons, and which, in tending towards equilibrium, emits radiation in the form of waves or particles.
4.20 Recognition: The process by which the contaminating agents of the working environment are identified; their properties or characteristics; the routes of entry into the human body; their effects on health; the sources emitting contaminants; the areas or zones where there is a risk of exposure; the homogeneous exposure groups, their job positions and the activities they carry out; the times and frequencies of exposure, as well as the personal protective equipment required.
4.21 Person responsible for the operation and functioning of X-ray equipment: The person authorised by the Ministry of Health as being in charge of radiological safety and protection and of compliance with the provisions laid down by that department as regards the use of X-rays.
4.22 Serious risk: A risk that may compromise the physical integrity and/or the life of workers and/or cause damage to the workplace installations, where the corresponding safety requirements and conditions are not observed.
4.23 Health surveillance; medical surveillance: The activity carried out by the physician, the purpose of which is to verify the health conditions of personnel at the start of their working life, to determine whether there is any impediment to performing the job, and to monitor periodically whether the health of occupationally exposed personnel has undergone relevant alterations requiring a new assessment for them to continue carrying out their activities.
4.24 Risk zone: An area where there is exposure to sources of ionising radiation and which is subject to special supervision and controls for radiological protection purposes.
5. Employer's duties
5.1 Have the analysis of the risks to which workers are exposed, according to the radiological characteristics of each source of ionising radiation, in accordance with the requirements of the competent regulatory body.
5.2 Have the radiological safety and protection programme, in accordance with Chapter 7 of this Standard.
5.3 Have an up-to-date list of the occupationally exposed personnel in the workplace containing, at least, the following information: a) The worker's name; b) The worker's Federal Taxpayer Registry number or Unique Population Registry Code; c) The activities that involve their exposure, and d) The risk zones where they carry out the work.
5.4 Have the radiological safety and protection manual, based on the requirements laid down by the competent regulatory body.
5.5 Have a directory of the regulatory bodies competent in the handling and control of ionising radiation, to request their assistance in the event of a radiological emergency.
5.6 Have the radiological emergency response plan, as determined by the competent regulatory body and in accordance with Chapter 8 of this Standard.
5.7 Adopt the radiological safety measures for handling sources of ionising radiation indicated by the competent regulatory body and in accordance with Chapter 9 of this Standard.
5.8 Carry out the recognition of the workplace areas where the sources of ionising radiation are located, in accordance with Chapter 10 of this Standard.
5.9 Demarcate the risk zones and place warning and prohibition signs for the presence of sources of ionising radiation, in accordance with Official Mexican Standards NOM-026-STPS-2008 and NOM-229-SSA1-2002, or those superseding them.
5.10 Have the ionising radiation measuring equipment, as provided for in the operating licence or the health licence, as applicable.
5.11 Have a programme for the calibration and maintenance of the ionising radiation measuring equipment, in accordance with the requirements of the operating licence or the health licence, as applicable.
5.12 Provide occupationally exposed personnel with the dosimeter, based on the requirements of the operating licence or the health licence, as applicable.
5.13 Evaluate and record the dosimetry values of occupationally exposed personnel and follow them up for control purposes, in accordance with Chapter 11 of this Standard.
5.14 Provide occupationally exposed personnel with the record of their annual and cumulative dose equivalent.
5.15 Implement the control measures laid down by the competent regulatory body, in accordance with the General Radiological Safety Regulations, as well as those contained in Chapter 12 of this Standard, so that the exposure of occupationally exposed personnel is reduced to the lowest possible level.
5.16 Have specific areas for placing personal protective equipment, as well as for the decontamination of occupationally exposed personnel and of the containers, devices and tools used, where there are unsealed sources of ionising radiation.
5.17 Comply in the risk zones with the safety conditions, in accordance with the General Radiological Safety Regulations.
5.18 Have a radiological safety officer or, where applicable, a person responsible for the operation and functioning of the X-ray equipment, as well as the assistants needed per work shift, based on the requirements of the General Radiological Safety Regulations or NOM-229-SSA1-2002, or those superseding them, as applicable.
5.19 Provide occupationally exposed personnel with personal protective equipment, in accordance with: a) NOM-017-STPS-2008, or those superseding it, and b) The General Radiological Safety Regulations, the operating licence and NOM-008-NUCL-2011, or those superseding them, or c) The health licence and NOM-229-SSA1-2002, or those superseding it.
5.20 Have the programme for the health surveillance of occupationally exposed personnel.
5.21 Carry out medical examinations on occupationally exposed personnel, in accordance with NOM-026-NUCL-2011, or those superseding it.
5.22 Carry out the health surveillance of occupationally exposed personnel, in accordance with Chapter 13 of this Standard.
5.23 Inform occupationally exposed personnel, the safety and hygiene committee and the occupational safety and health preventive services, according to their responsibilities, about: a) The risks to which they are exposed in carrying out their activities through the handling of sources of ionising radiation, and b) The radiological protection they shall comply with.
5.24 Provide training to occupationally exposed personnel on radiological protection, in accordance with Official Mexican Standards NOM-031-NUCL-2011 and NOM-034-NUCL-2009, or those superseding them, and Chapter 14 of this Standard.
5.25 Transfer occupationally exposed personnel to another area if, as a result of the medical opinion, it is considered inappropriate to continue exposing them to ionising radiation in the course of their normal employment.
5.26 Have the authorisations, licences and permits granted by the competent regulatory bodies, in accordance with Chapter 15 of this Standard.
5.27 Prevent workers who, on medical prescription, do not meet the conditions for performing the work from being exposed to sources of ionising radiation.
5.28 Prevent occupationally exposed personnel exposed to sources of ionising radiation from exceeding the dose limits indicated in the General Radiological Safety Regulations.
5.29 Prohibit the bringing in and consumption of food and drink, as well as smoking or applying cosmetics, in the risk zones.
5.30 Prohibit women who are pregnant or breastfeeding from working in places where there is a risk of exposure to sources of ionising radiation, in accordance with the notification referred to in paragraph
6.11 of this Standard.
5.31 Prohibit persons under 18 years of age from working in places where there is a risk of exposure to sources of ionising radiation.
5.32 Present to the labour authority, when it so requests, the documents that this Standard requires the employer to draw up or hold.
6. Duties of occupationally exposed personnel
6.1 Comply with the provisions of the radiological safety and protection manual.
6.2 Wear and keep in good condition the personal protective equipment provided by the employer, the dosimeters and the ionising radiation measuring equipment, in accordance with the manufacturer's instructions for use and maintenance.
6.3 Attend and pass the training courses given by the employer on radiological safety.
6.4 Apply the radiological safety actions involving the handling of sources of ionising radiation, in accordance with the standards and procedures of the competent regulatory body.
6.5 Keep exposure to ionising radiation as low as possible.
6.6 Check that their person, clothing and equipment are not contaminated when leaving a risk zone.
6.7 Avoid generating radioactive waste or residues.
6.8 Undergo the medical examinations that the employer arranges for them.
6.9 Take part in carrying out the radiological emergency response plan.
6.10 Notify the radiological safety officer or the person responsible for the operation and functioning of the X-ray equipment, as applicable, immediately about the presence of unsafe conditions relating to the sources of ionising radiation.
6.11 Notify the employer in writing, in the case of women workers who are pregnant or breastfeeding, of this condition and, where applicable, present the corresponding medical certificate.
7. Radiological safety and protection programme
7.1 The radiological safety and protection programme shall contain, at least, the following: a) The activities for complying with the programme, their duration and those responsible for their implementation and supervision; b) The manual of administrative and operating procedures as regards radiological safety; c) The description of the administrative and technical resources, as well as of the communication and coordination system between the different areas involved in the workplace for compliance with the programme, and d) The procedures for investigating incidents or accidents.
8. Radiological emergency response plan
8.1 The radiological emergency response plan shall be drawn up in accordance with the requirements of the competent regulatory body and the provisions of this Chapter.
8.2 The radiological safety officer or, where applicable, the person responsible for the operation and functioning of the X-ray equipment, as well as the assistants needed per work shift, shall apply the radiological emergency response plan for as long as required.
8.3 The radiological emergency response plan shall provide for, at least, the following: a) The description of the foreseeable emergency situations, the measures to be adopted in each case and those responsible for carrying them out; b) The limitations and restrictions on exposure during the emergency for occupationally exposed personnel and for persons near that emergency; c) The first aid to be given to workers and their immediate referral for medical assistance; d) Carrying out activities to control the abnormal situation, and e) The application of corrective measures, in accordance with the dose equivalent limits, once control of the emergency has been achieved.
8.4 Personnel taking part in emergency operations shall, under the terms of the radiological emergency response plan: a) Be informed about the risks involved in irradiation exceeding the dose equivalent limits laid down in the General Radiological Safety Regulations; b) Have training and instruction for the specific operations to be carried out; c) Have the written authorisation of the radiological safety officer, and d) Be provided with suitable equipment and clothing for their protection, so that external irradiation and contamination are minimal.
9. Radiological safety measures
9.1 Administrative measures
9.1.1 In workplaces where sources of ionising radiation are handled, it shall be ensured that the limits on the intake of radioactive material by occupationally exposed personnel are not exceeded, based on the requirements of the General Radiological Safety Regulations and NOM-005-NUCL-1994, or those superseding it.
9.1.2 Likewise, it shall be supervised that the radioactive contamination values in the risk zones do not exceed the limits indicated in NOM-008-NUCL-2011, or those superseding it.
9.1.3 All activities involving exposure to ionising radiation must take into account: a) The source of ionising radiation; b) The times and frequencies of exposure, and c) The application of a dose limitation system comprising: 1) The justification of work practices, and 2) The optimisation of radiological protection.
9.1.4 In the risk zones, radiological safety procedures shall be adopted, as applicable, so as to: a) Prevent unjustified access by workers, materials and objects liable to contamination, and b) Control the removal of objects with surface contamination higher than the limits laid down in NOM-008-NUCL-2011, or those superseding it.
9.2 Safety measures
9.2.1 The protective measures in the installations and risk zones shall take into account, as applicable, the following: a) The times and frequencies of exposure; b) Increasing the distance between the worker and the source of ionising radiation; c) The use of protective shielding; d) The use of remote devices or controls, in those cases where this is justified, and e) The provision of alarms and fire-extinguishing equipment or, where applicable, fire detection and extinguishing systems.
9.2.2 The protective measures for handling unsealed sources, in accordance with the requirements of the competent regulatory body, shall take into account the following: a) The maintenance of smooth surfaces, free from pores and cracks, in such a way as to allow easy reduction or elimination of radioactive contamination; b) The provision of ventilation systems allowing the evacuation of the gases or aerosols produced, including the installation of filters, so as to prevent the release of contamination into the environment, and c) The use of ionising radiation detection equipment to check for possible radionuclide contamination on leaving the risk zones.
9.2.3 Where radioactive material is present, the following radiological safety measures shall be adopted: a) The equipment and protective clothing used may not leave a risk zone until they have undergone a decontamination process to reduce or eliminate the radioactive contamination, and b) Once the personal protective equipment has been used, it shall be stored in properly marked containers, in accordance with NOM-026-STPS-2008, or those superseding it.
9.3 Measures for radioactive waste
9.3.1 The management of the radioactive waste generated in the work areas shall be carried out, from its origin, in accordance with the requirements of the competent regulatory body.
10. Recognition
10.1 The recognition carried out in the areas where there are sources of ionising radiation shall comprise, at least: a) The identification and location of the sources of ionising radiation; b) The physical and chemical properties of the sources of ionising radiation; c) The effects that the sources of ionising radiation may produce on the health of occupationally exposed personnel; d) The condition and type of control systems for the sources of ionising radiation or the equipment containing them, as well as of other physical and radiological protection devices; e) The unsafe conditions and acts that may cause an accident or another type of ionising radiation risk; f) The location of occupationally exposed personnel by area and shift, where applicable, specifying the job positions and the activities they carry out; g) Consideration of time, distance and shielding; h) The identification of the characteristics of the personal protective equipment to be used, where applicable, and i) The inventory of ionising radiation detection equipment and measuring instruments.
10.2 The recognition of the areas where there are risks of contamination from sources of ionising radiation shall be carried out: a) With the frequency laid down by the competent regulatory body; b) When the sources of ionising radiation are replaced, and c) When failures occur in the equipment using sources of ionising radiation.
10.3 The reports on the recognitions carried out shall be kept, in documentary form or by electronic means, for at least twelve months.
11. Evaluation
11.1 The type of evaluation to be carried out so as to establish the magnitude of the dose received by occupationally exposed personnel, or the contamination in the work areas, furniture, equipment and materials, shall be defined on the basis of the results obtained in the recognition.
11.2 The selection of the instrument to be used for evaluating ionising radiation shall be made in accordance with the results of the recognition.
11.3 The instruments used for the evaluation shall have the document attesting to their calibration being in force, in accordance with NOM-012-NUCL-2002, or those superseding it.
11.4 The evaluation of the dose to occupationally exposed personnel shall take into account the individual dosimetry records and shall not exceed the annual dose equivalent limits laid down in the General Radiological Safety Regulations.
11.5 The evaluation and recording of the ionising radiation levels in the risk zones shall be carried out in accordance with the procedures drawn up for that purpose.
11.6 The frequency with which the evaluation of ionising radiation is carried out shall be subject to the procedure established for that purpose and to the requirements laid down by the competent regulatory body.
11.7 The dose equivalent of occupationally exposed personnel accumulated during the previous calendar year and the total accumulated during their working life in the workplace shall be kept up to date, so as to maintain permanent surveillance of the trends in the dose equivalent received and to optimise occupational safety and health conditions.
11.8 The results of the evaluations carried out shall be recorded each time they are performed.
12. Control
12.1 Where the dose equivalent limits established in the General Radiological Safety Regulations are exceeded, an analysis shall be carried out of the root cause that gave rise to the event, and the relevant control measures shall be applied, as applicable, including among others: a) Stopping the activity; b) The review of procedures; c) The review of the design and fitting-out of the installations; d) The limitation of the times and frequencies of exposure of occupationally exposed personnel to sources of ionising radiation; e) The containment of sources of ionising radiation; f) The introduction of safety devices; g) The use of specific personal protective equipment based on the type of ionising radiation, and h) The reinforcement of training and instruction.
12.2 The control measures shall be followed up in the workplace.
12.3 The reports on implementing the control measures and their follow-up shall be kept in documentary form or by electronic means for at least twelve months, or for the period laid down by the competent regulatory body.
13. Health surveillance of occupationally exposed personnel
13.1 The medical surveillance of occupationally exposed personnel shall be the responsibility of a physician with knowledge and experience in occupational medicine and/or in the biological effects of ionising radiation.
13.2 The programme for the health surveillance of occupationally exposed personnel shall take into account: a) The compilation of the clinical history and carrying out pre-employment medical examinations, as set out below: 1) Worker identification data; 2) Family medical history (FMH); 3) Personal non-pathological history (PNPH); 4) Personal pathological history (PPH); 5) Occupational history; 6) Current conditions, where applicable; 7) Review of organs and systems; 8) Physical examination, with emphasis on the acuity of the senses and ease of expression so as to be able to transmit, rapidly and accurately, spoken or written communications or any signal, whether tactile, audible or visible; 9) Laboratory and imaging tests, comprising blood group and Rh, as well as a full blood count; 10) Auxiliary diagnostic studies at the physician's discretion, and 11) Diagnostic impression, with emphasis on the physical normality of the motor parts essential for performing their professional activity with dexterity of movement, allowing them to reach access points quickly and to carry out the functions assigned to them, and b) Periodic examinations carried out on an annual basis, subject: 1) To the analysis of the type of work that the occupationally exposed personnel has been carrying out and the risks to which they have been subject as a consequence of it, and 2) To the dosimetric history, so as to identify early effects on the health of occupationally exposed personnel.
13.3 For occupationally exposed personnel, the registration record shall be generated, the initial medical examination carried out and the medical certificate of fitness issued.
13.4 The physician shall compare the results of the periodic examinations with the initial ones, so as to detect and act should any early alteration to the health of occupationally exposed personnel be identified. If the physician considers it necessary to carry out complementary studies, these shall be performed according to the job position; the history of exposure to ionising radiation, as well as the age and state of health of the occupationally exposed personnel.
13.5 For occupationally exposed personnel, a medical file shall be compiled, which shall be kept, in written or electronic media, for up to 30 years after the end of their employment relationship, and shall contain, at least: a) The occupational history with previous and current exposures to the risk; b) The clinical history; c) The laboratory tests, and d) The auxiliary diagnostic studies.
14. Training and instruction
14.1 Training and instruction shall take into account the provisions of Official Mexican Standards NOM-031-NUCL-2011, NOM-034-NUCL-2009 or NOM-229-SSA1-2002, or those superseding them, as applicable.
14.2 Instruction shall be provided to occupationally exposed personnel at least every twelve months.
14.3 Training and instruction shall cover, for emergency cases, the potential radiological accidents occurring during routine operations for handling sources of ionising radiation.
14.4 Training and instruction shall take into account, as applicable, the following: a) The principles of radiological safety; b) The risks of ionising radiation; c) The quantities and units of ionising radiation; d) The concept of the "lowest possible level" of workers' exposure to ionising radiation and its benefits; e) The radiological protection factors, such as time, distance and shielding; f) The radiological safety procedures of the installation applicable by occupationally exposed personnel; g) The responsibilities of occupationally exposed personnel arising from their job position as regards radiological protection; h) The types of ionising radiation detection and measuring instruments; i) The proper use and maintenance of personal protective equipment; j) The radiological emergency response plan, including first aid procedures, and k) The regulations applicable to radiological protection.
14.5 A record shall be kept of the training and instruction provided, covering at least the following: a) The person's name; b) The date on which it was given; c) The topics covered; d) The instructor's name, and e) The document proving that the training and instruction were given.
15. Authorisations, licences and permits
15.1 The authorisations, licences and permits granted by the competent regulatory bodies for handling sources of ionising radiation shall be held, as applicable in each case: a) The authorisation to install sources of ionising radiation, to service equipment containing them and to provide radiological protection services; b) The operating licence for radioactive installations; c) The health licence for the establishment using radiation sources for medical or diagnostic purposes, in the form of X-rays, nuclear medicine and/or radiotherapy; d) The permits and licences relating to radioactive waste; e) The permit of the radiological safety officer; f) The permit of the person responsible for the operation and functioning of the establishment using radiation sources for medical or diagnostic purposes, in the form of X-rays, nuclear medicine and/or radiotherapy, and g) The permit of the specialist adviser on radiological safety for medical X-ray diagnostic establishments.
16. Verification units
16.1 The employer shall have the option of engaging an accredited and approved verification unit, in accordance with the Federal Act on Metrology and Standardisation, to verify compliance with this Standard.
16.2 Verification units assessing conformity with this Standard shall apply the compliance criteria indicated in the conformity assessment procedure of Chapter 17 of this Standard.
16.3 Accredited and approved verification units assessing compliance with this Standard shall issue a verification report, which shall contain: a) Workplace data: 1) The name, denomination or business name; 2) The full address (street, number, district, municipality or borough, city, federal state, postcode), and 3) The name and signature of the employer or of their legal representative, and b) Verification unit data: 1) The name, denomination or business name; 2) The registration number granted by the accreditation body; 3) The approval number granted by the Ministry of Labour and Social Welfare; 4) The code and name of the Standard verified; 5) The dates on which the accreditation and approval were granted; 6) The result of the verification; 7) The name and signature of the person responsible for issuing the report; 8) The place and date of signature of the report; 9) The period of validity of the report, and 10) The registration number of the report granted by the Ministry of Labour and Social Welfare when the respective return is filed.
16.4 The verification reports issued by verification units shall be valid for one year.
17. Conformity assessment procedure
17.1 This conformity assessment procedure applies both to inspection visits carried out by the labour authority and to verification visits carried out by verification units.
17.2 The verification report in force shall be available to the labour authority when it so requests.

17.5 The documentary evidence or the records referred to in this Standard may be presented in printed form or on electronic media, and shall be kept for at least twelve months, except in those cases where the Standard lays down a different period of validity.

Enforcement of compliance with this Standard is the responsibility of the Ministry of Labour and Social Welfare.

20. Concordance with international standards
This Standard does not concord with any international standard, as no reference existed at the time of its drafting.
TRANSITIONAL PROVISIONS
FIRST.- This Official Mexican Standard shall enter into force four months after its publication in the Official Journal of the Federation. SECOND.- During the period provided for in the preceding article, employers shall comply with Official Mexican Standard NOM-012-STPS-1999, Safety and hygiene conditions in workplaces where sources of ionising radiation are produced, used, handled, stored or transported, or shall make the adaptations needed to observe the provisions of NOM-012-STPS-2012, Safety and health conditions in workplaces where sources of ionising radiation are handled. In the latter case, the labour authority shall provide, at the request of interested employers, advice and guidance for implementing compliance, without the employers becoming liable to penalties for non-compliance with the standard in force. THIRD.- From the date on which this Standard enters into force, Official Mexican Standard NOM-012-STPS-1999, Safety and hygiene conditions in workplaces where sources of ionising radiation are produced, used, handled, stored or transported, published in the Official Journal of the Federation of 20 December 1999, shall cease to have effect.
